1. vues par la loi l utilisateur ne peut faire aucune autre copie reproduction temporaire ou permanente aucune traduction ajustement classification ou transformation Il ne peut davantage louer pr ter distribuer tiers mettre sur le march ou quelque autre forme de distribution utilis dans un r seau interne ou externe internet intranet etc sauf avec autorisation pr alable et crite de VAT Applications SA A la r serve des exceptions pr vues par la loi l utilisateur ne peut en aucun cas d compiler ou d monter le logiciel Article 4 Plaintes VAT Applications garantie que CETTE APPLICATION est livr en bon tat apparent de conditionnement Si tel n est pas le cas l utilisateur doit en informer VAT Applications SA dans les 15 jours qui suivent la r ception de CETTE APPLICATION sur quoi VAT Applications SA remplace l exemplaire endommag par un exemplaire en bon tat VAT Applications ne fournit pas de service d entretien et ne peut tre oblig de fournir assistance a l installation Article 5 Responsabilit VAT Applications SA garantie uniquement qu elle a consacr une attention raisonnable composer et faire CETTE APPLICATION VAT Applications SA ne garantie pas que CETTE APPLICATION est sans fautes et qu il correspond certaines attentes ou buts Le logiciel est uniquement destin la formation et l ducation de l utilisateur CETTE APPLICATION n est pas destin pour la comptabilit o2. 3. raisonnements de la l gislation TVA Les r sultats ne peuvent en aucun cas tre consid r s comme des solutions concr tes et exhaustives pour des probl mes r els de TVA Pour ces derniers l utilisateur devra toujours faire appel a des conseils ind pendants professionnels et ou devra consulter des manuels et des l gislations de TVA Article 2 Propri t intellectuelle Les droits de propri t s intellectuelles du logiciel en comprenant sa structure mode de fonctionnement ses codes ses codes sources ses codes objets ses micro codes etc des documents suppl mentaires et ou du manuel d utilisation des banques de donn es ainsi que le know how ce propos sont et restent la propri t de VAT Applications SA Ils sont entres autres prot g s par le droit d auteur et les conventions internationales applicables L utilisateur s engage ne pas violer les droits de VAT Applications SA et de prendre les mesures n cessaires afin d assurer le respect des droits de VAT Applications SA aupr s des personnes pour qui il se porte garant Article 3 Droit d utilisation L utilisateur s engage ne prendre aucune copie du logiciel l exception d une copie de r serve Cette copie de r serve ne peut tre utilis e que lorsque le logiciel livr ne fonctionne plus et ce sous les m mes conditions que le logiciel d origine et moyennant connaissance crite pr alable VAT Applications SA A la r serve des exceptions pr
4. voor het nemen van de nodige maatregelen ter bescherming en tot het behoud van de gegevens die zijn systeem bevat en van de integriteit van zijn systeem Artikel 6 Schadevergoeding Indien de gebruiker de bepalingen van deze gebruikslicentie schendt moet de gebruiker VAT Applications NV vergoeden voor alle geleden schade directe en of indirecte verliezen en kosten die daaruit voortvloeien alsmede voor alle gederfde winst met inbegrip van het verlies van opportuniteiten Indien de gebruiker handel gedreven heeft met name door middel van illegale kopies ongeoorloofd gebruik van de programmatuur rechtstreeks of via een vennootschap waarin hij een belang heeft zal hij van rechtswege een forfaitaire schadevergoeding van EUR 25000 per onrechtmatige kopie verschuldigd zijn aan VAT Applications NV zonder dat dit afbreuk doet aan het recht van VAT Applications NV een hogere schadevergoeding waarvan zij het bewijs levert te eisen VAT Applications NV behoudt zich daarenboven het recht voor om een strafrechterlijke vervolging in te stellen uit hoofde van onder andere namaak Artikel 7 Bevoegdheid en toepasselijk recht Elk geschil betreffende de geldigheid uitvoering of interpretatie van deze gebruikslicentie valt onder de uitsluitende bevoegdheid van de rechtbanken van het arrondissement Brussel die uitsluitend het Belgische recht zullen toepassen Voor vragen omtrent deze gebruikslicentie neem contact op met VAT Applications NV per brie
5. 21 BTW BE 473 356 139 hierna genoemd VAT Applications NV en de koper van DEZE APPLICATIE hierna de gebruiker genoemd wordt uitdrukkelijk overeengekomen dat de gebruikslicentie een overeenkomst vormt tussen de partijen waarvan de bepalingen voorrang hebben op elke andere beschikking of document dat uitgaat van de gebruiker of enige derde Artikel 1 Licentie VAT Applications NV kent aan de gebruiker een niet exclusief en niet overdraagbaar gebruiksrecht toe om de op DEZE APPLICATIE aanwezige programmatuur hierna de programmatuur te gebruiken in overeenstemming met deze algemene voorwaarden waarbij elk gebruik dat niet uitdrukkelijk toegestaan werd door deze algemene voorwaarden of door de wet voorbehouden blijft aan VAT Applications NV De aankoop van DEZE APPLICATIE leidt niet tot de overdracht of cessie aan de gebruiker van eender welk intellectueel eigendomsrecht DEZE APPLICATIE heeft als doelstelling de gebruiker vertrouwd te maken met de redeneringen van de BTW wetgeving De resultaten mogen op zich onder geen beding worden aanzien als concrete en exhaustieve oplossingen voor re le BTW problemen waarvoor de gebruiker nog steeds onafhankelijk professioneel advies zal dienen in te winnen en of handleidingen en wetgeving inzake BTW zal dienen te raadplegen Artikel 2 Intellectuele eigendom De intellectuele eigendomsrechten van de programmatuur met inbegrip van haar structuur werkwijze haar codes de source code de object co

CATION contraire aux indications d utilisations et tout autre utilisation d raisonnable L utilisateur est responsable de l utilisation qu il fait des donn es comprises dans le logiciel et ou des r sultats obtenues apr s l utilisation du logiciel L utilisateur est galement responsable prendre les mesures n cessaires afin de prot ger et de conserver les donn es que contient son programme et l int grit du syst me Article 6 Indemnit Dans le cas o l utilisateur violerait cette licence d utilisation l utilisateur doit compenser VAT Applications SA pour tous les dommages caus s directs ou indirects pertes et co ts qui en d coulent ainsi que les gains perdus y compris les pertes d opportunit s Lorsque l utilisateur a exerc un commerce par exemple en vendant des copies ill gales par l utilisation illicite du logiciel directement ou par le biais d une soci t dans laquelle il a un int r t il devra de droit une indemnit forfaitaire de EUR 25000 par copie illicite VAT Applications SA sans pour cela retirer le droit VAT Applications SA d exiger une indemnisation plus lev e dont VAT Applications SA apportera la preuve VAT Applications SA se r serve galement le droit d introduire une poursuite p nale notamment pour cause de contrefa on Article 7 Comp tence et droit applicable Tout conflit concernant la validit l ex cution ou l interpr tation de cette licence d utilisation tombe sou

T Applications NV De gebruiker mag op geen enkele wijze de programmatuur decompileren of uiteennemen behoudens voor de bij wet voorziene uitzonderingen Artikel 4 Klachten VAT Applications NV waarborgt dat DEZE APPLICATIE zonder zichtbare gebreken geleverd wordt Indien dit niet het geval zou zijn dient de gebruiker VAT Applications NV hiervan in kennis te stellen binnen de 15 werkdagen volgend op de ontvangst van DEZE APPLICATIE waarop VAT Applications NV gratis het beschadigde exemplaar zal vervangen door een exemplaar in goede staat VAT Applications NV verschaft geen onderhoudsservice en kan niet verplicht worden bijstand te verlenen bij de installatie Artikel 5 Aansprakelijkheid VAT Applications NV waarborgt enkel en alleen dat zij een redelijke zorg heeft besteed aan het samenstellen en aanmaken van DEZE APPLICATIE VAT Applications NV garandeert niet dat DEZE APPLICATIE zonder fout is of aan gegeven verwachtingen of doelstellingen voldoet De programmatuur is uitsluitend bestemd voor de vorming en de opleiding van de gebruiker DEZE APPLICATIE is niet bestemd voor het voeren van een boekhouding of een BTW administratie VAT Applications NV heeft redelijke inspanningen geleverd bij het tot stand brengen van de programmatuur wat echter niet uitsluit dat verbeterde nieuwe of bijgewerkte versies ervan uitgebracht kunnen worden zonder dat VAT Applications NV daartoe verplicht kan worden op vraag van de gebruiker Wanneer de gebruiker
9. de de micro code enz van de bijgevoegde documentatie en of het gebruikershandboek het databank recht evenals de know how daaromtrent zijn en blijven de eigendom van VAT Applications NV Zij worden onder andere beschermd door het auteursrecht en de toepasselijke internationale verdragen De gebruiker verbindt zich ertoe om geen inbreuk te plegen op de rechten van VAT Applications NV en om de nodige maatregelen te nemen om de eerbiediging van de rechten van VAT Applications NV door de personen waarvoor hij instaat te verzekeren Artikel 3 Gebruiksrecht De gebruiker verbindt zich ertoe geen enkele kopie van de programmatuur te maken met uitzondering van n enkele reservekopie die slechts gebruikt mag worden indien de geleverde programmatuur niet meer functioneert en in dat geval tegen dezelfde voorwaarden die golden voor de oorspronkelijke programmatuur en slechts na VAT Applications NV hiervan schriftelijk en voorafgaandelijk in kennis gesteld te hebben Behoudens de bij wet voorziene uitzonderingen mag de gebruiker geen enkele andere kopie permanente of tijdelijke reproductie geen enkele vertaling aanpassing ordening of transformatie maken of doorvoeren Evenmin mag hij overgaan tot het verhuren uitlenen verdelen aan derden het op de markt brengen of eender welke andere vorm van verspreiding het gebruik in een intern of extern netwerk internet intranet enz behoudens met voorafgaandelijke en schriftelijke toestemming van VA
