4. enviornment and which are compatible with the wilderness experience sought by visitors to these areas All forms of commercial activity as well as the use of combustion engines for recreational purposes shall be prohibited in Nature Conservancy Areas Activities considered to be compatible with the Nature Conservancy concept include hiking and climbing canoeing and rowing camping nature study and photography Traileriding and fishing shall also be permitted in areas where deterioration of the natural resource will not result Use quotas will be established if the popularity of an activity reaches a point where the impact of participation in the activity is considered detrimental to the natural processes of the area Any improvement or development will be limited to that which is ree quired to protect the natural envixonment and to insure the safety of the usere Such development might include a trail system primitive camping areas and information and reception centres at entry points including the provision of suitable boats where necessary Forest and wildlife management and protection measures will be im plemented only when it is necessary to correct or control unnatural situations induced by human activities RECOMMENDED LLOYD BROOKS Deputy Minister APPROVED IR A WILLIAMS Minister September 14 1972
5. his level if it is contrary to the Park Act or Policy However if he is unsure or if it may be permissible he should request the applicant to write directly to him outlining the request The request will then be investigated at the field level and sent up the line along with comments and recommendations to Victoria for final adjudication No permit will be issued until a written ap lication signed by the applicant has been received by the Director Parks Branch Upon the receipt of an application for a new park use permit procedure shall be as follows a Management Division shall obtain complete and precise information regarding the proposed activity and requirements of the applicant b Management Division shall determine if the proposed activity can be legally authorized by a Park Use Permit under the Park Act Example section 9 1 C Park Act no natural resource within a park of any class having an area of five thousand acres or less or within a nature conservancy area shall be granted sold removed destroyed damaged disturbed or exploited Unauthorized Use and Occupancy of Park Lands District Superintendents are responsible to research and in vestigate all unauthorized occupancy and use of Park lands within their districts which require a Park Use Permit Complete and precise information regarding the unauthorized activity shall be forwarded to the Director Parks Branch with recommendat
6. means Crown Land reserved or set aside for public recreational use and established as a recreation area under the Park Act Resource Use Permit means a licence issued under this Act authorizing an activity or course of behaviour or conduct or the occupancy use development exploitation or extraction of a natural resource on or in a recreation area 1973 c 67 s 1 II ADMINISTRATION OF PARK USE PERMITS A Park Use Permits General The Parks Branch is charged with the responsibility of managing and administering many activities within Provincial Parks and this is done by the issuing of Park Use Permits as required Parks are public lands primarily intended for the enjoyment of the public and therefore require a high order of protection When permits are granted to an individual group or to a company for industrial exploitation etc they tend to restrict and limit the public enjoyment of park lands It has been determined in a Court of the Province that a Park Use Permit is in fact a form of licence rather than a lease A Park Use Permit grants a specific privilege to a specific Permittee and authorizes the Permittee to do something which is otherwise pro hibited by law A Park Use Permit is non transferable Section 27 Park Act hence it is not negotiable it is not property and cannot be classed as a form of security for financial purposes A Park Use Permit cannot be bequested to an heir and one company canno

9. ancelled and application for a new permit will not be accepted Upon the receipt of an application from the permittee for the continuation of a Park Use Permit Management Division shall redraft the existing permit and if required may add any special conditions needed to improve control and supervision of the Permit Endorsement validation and distribution of the permit shall be the same as stated in Section 4 d Supervision of Park Use Permits Supervision of Park Use Permits is an important function of the District Superintendent in the administration of the Parks in his District Regional Managers and especially District Superintendents must familiarize themselves with the terms and conditions of all permits authorized in their District and shall conduct inspections of the permit area from time to time 1 Inspections a Supervision of all Park Use Permits is the direct responsibility of the District Superintendent who must submit at least one inspection report per year on each permit to the Regional Manager who in turn reviews the report and forwards it to Management Division Vexing or troublesome permits should be inspected on a more frequent basis b All inspection reports must be received at least thirty 30 days before the anniversary or expiry date of the permit by Management Division This will facilitate the addition of new conditions if required on permits which are to be renewed c It is the r
10. ancy areas and our intention is to deactivate all trap lines in such areas by January 1 1976 After the Nature Conservancy areas are free of traplines the Parks Branch will then proceed with the gradual elimination of all other trap lines within Provincial Parks Phasing out of traplines will proceed as follows l identification of all traplines within parks 2 legalization by Park Use Permits of all bona fide traplines 3 co operation of Fish and Wildlife Branch to transfer trappers to viable alternative areas if available Trapping General Es All registered trap lines licensed under the provisions of the Wildlife Act will be honoured by the Parks Branch Park Use Permit until such time as they are transferred to other viable areas or are phased out altogether Upon the cancellation or otherwise termination of a trapping license the license and permit authorizing the activity will not be renewed Park Use Permits for trapping shall be issued on a one year renewable basis Permits are not transferable or negotiable and the Parks Branch will not contemplate or consider the purchase of a trapline Closure of Trapping in Provincial Parks a In the event of the imposition of a Nature Conservancy Area over a registered trapline the trapper shall be given three 3 years notice in which to terminate all activity b In the event of the total closure of trapping within a Park or on a trapline within a Park the trapper
11. ans a person who for remuneration received or promised assists another person to hunt any game or in finding angling for or catching any game fish in circumstances wherein a licence is required under the Wildlife Act Guide Outfitter l1 guiding territory registered on a Guide Outfitter s certificate 2 guiding territory endorsed on licence and only as a condition of the licence territory is not treated as a chattel should the licencee die before the end of the licence year Guiding is considered a commercial activity and thusly all such activities which utilize Provincial Park lands must be authorized by a Park Use Permit At present we have many historic guiding territories within Provincial Parks which either predate the Parks or were authorized by past administrations In recent years the Parks Branch has superimposed new Parks over existing guiding territories held under Guide Outfitters Certificates issued by the Fish amp Wildlife Branch Certificates are issued for a term not exceeding 15 years and grants the holder an exclusive right to act as a guide for specified species in a single specified territory All Guide Outfitters Certificates are destined to terminate on March 31 1987 Park Use Permits will be issued to authorize only existing guides currently operating within Provincial Parks and no new guides or guide territories will be authorized by either Parks Branch or Fish and Wildlife Branch The Parks Bran
12. ch will not consider the purchase of any guiding territory or guiding rights held within Provincial Parks Guide Outfitters Certificates l All Guide Outfitters Certificates issued under the provisions of the Wildlife Act which predate the creation of a Park will be honoured by the Parks Branch for the full term remaining on the Certificate none issued after Park created 2 Upon the expiry of a Guides Outfitters Certificate the Certificate shall not be renewed and shall revert in total to the jurisdiction of the Parks Branch If the Parks Branch desires the continuation of guiding a guiding territory bra 8 allocated as a condition of licence will be authorized and the historic guide will have first right of refusal In the event of the death of a Certificate holder the privileges shall remain in the right of the spouse for the term remaining on the Certificate The spouse may with the approval of the Director Fish amp Wildlife Branch allow another qualified guide to operate within the Territory as his her sole agent In the event of the death of both Certificate holder and spouse all rights and privileges of the Certificate shall be considered terminated and revert in total to the jurisdiction of the Parks Branch and shall not be transferred Guiding Territories Allocated as a Condition of Licence La Exisiting guides shall be licensed under the Wildlife Act and be authorized by the Parks Branch with a Park Use P
13. ermit Park Use Permits shall be issued for a maximum term of three 3 years renewable at the discretion of the Director Parks Branch Upon the expiry or otherwise termination of Park Use Permits all rights shall revert to the Parks Branch Permits are non transferable and the guiding territories or right are not saleable Certificates and Guiding Licences are subject to the following provisions 1 Closure of hunting season or species a In the event of the imposition of a Nature Conservancy Area over a guiding territory the guide shall be given three 3 years notice to terminate all activity b In the event of the total closure of hunting within a Park or a territory within a Park the guide shall be given the following notice 1 One 1 year notice for closure by Fish amp Wildlife Branch ii Three 3 years notice for closure by Parks Branch c In the event of the closure of hunting to a certain species by Fish amp Wildlife or Parks the guide concerned shall receive one 1 year s notice All Special Use Permits and Land Use Permits issued under the Provisions of the Forest Act or the Land Act for campsites or cabins used for guiding shall be transferred to the Parks Branch and authorized by a Park Use Permit The location and construction of all trails contemplated by the guides within Parks shall be approved and authorized by the Director Parks Branch Provisions of the Wildlife Act and Park
14. es 6 conditions for control of the authorized activity Es Regional Managers shall forward copies to Victoria Headquarters and the District concerned In order to facilitate a proper control system for filing at Victoria Headquarters all Letters 4 of Authority shall be numbered consectitively by each Region during the calendar year Example Re Letter of Authority 1 1975 tre gt IV STATEMENTS OF PoLicy A Performance Bonds for Industrial Exploitation Within Provincial Parks Statement of Policy Section 26 of the Park Act states Before issuing a Park Use Permit the Minister or his authorized agent may requtre the person to whom tt ts See to tissue the permit to pay to Her Majesty the Queen in right of the Province a sum of money which the Minister or that agent considers sufficient to defray the costs of the restoration or repatr of the park or parks concerned necessitated by the use authorized by the permit With the possibility of more permits being issued for mineral exploration and development work on existing mineral claims within parks and recreation areas we have a need to standardize per formance bond requirements Performance bonds have two main functions 1 A financial force to insure that the Permittee will abide by the conditions of the permit Performance bonds are subject to forfeiture on non compliance of permit conditions 2 Upon non compliance by Permittee and resulting Park Use Permit ca
15. es or occupancy of Park Lands by individuals groups or companies which utilize Park lands for selective use or private gain i e cabins guiding or mineral exploitations Park Use Permits are used as a licence to control uses within parks with the main function to preserve park values and to enhance public recreational use of our Parks Permits when issued should authorize a single activity operation or installation For example if an applicant is authorized to guide and to trap two permits should be issued one to guide and one to trap In our attempts to reduce the number of permits we may be tempted to expand certain permits to include multiple uses which in fact tend to complicate the permit and defeat desired simplicity Applications for Park Use Permits Section 25 of the Park Act states No park use permtt shall be tssued to authorize the removal destruction disturbance damaging or exploitation of any natural resource or any work occupancy undertaking or activity incidental thereto unless a A written application has been made therefore by the person to whom the permit ts issued Example P U P 477 Western Mines AY Normally all applicants seeking Park Use Permits address their applications to the Director Parks Branch When applicants either in person or in writing approach field staff regarding permits it is expected that the Park Employee concerned will dispose of the request at
16. esponsibility of the District Superintendent to insure that infractions of the terms or conditions of a permit are drawn to the attention of the permittee as soon as possible and that all practical efforts are made to ensure proper observance by the permittee of the terms and conditions d Violations infringements and or failures to comply with the terms or conditions of a permit by the permittee will be corrected by the District Superintendent by advising the permittee in writing of the infringement and requiring compliance within a set period of time i e one month A copy of the inspection report listing the violations should also be sent to the Permittee Copies of all correspondence shall be forwarded to Management Division e Flagrant willful or continued disregard for the Park Act Park Regulations or the terms or conditions of a permit by a permittee must be reported in detail in writing to the Director Attention Management Division Management Division is responsible for following up and reinforcing efforts of the field staff and advising a defaulting permittee that failure to comply with the terms and conditions within a set period of time will lead to cancellation of the permit g When in the opinion of the Chief of Management modification or cancellation of a park use permit is necessary or advisable details and recommendations shall be forwarded to the Director who after consultation with the Minis

18. ions concerning the issuance of the permit Issuing New Park Use Permits a Before recommending issuance of a new park use permit Management Division shall draft a sample permit and with it forward all available information to the Regional Manager and relevant Headquarters Divisions Regional Staff and other Divisions concerned shall review draft permit and recommend special con ditions or requirements to be added to the permit for proper control and supervision b Upon the receipt of recommendation from both Regional Staff and relevant Divisions Management Division shall prepare a final draft clearly outlining the following i Name and address of the permittee ii Precise nature and extent of the activity or operation to be authorized iil Expiry date of the proposed permits v Addition of such special terms and conditions that are necessary to safeguard the public interest in the park involved i e Bonding c Management Division shall endeavour to limit the permission granted to that which is essential to the accomplishment of the purpose of the permit Care shall be taken to insure that the permit states precisely who is authorized to do what and where and for how long the use is authorized d Management Division shall forward two copies of the permit plus billing for endorsement by the permittee Upon return of the permit and the required fees the permit shall then be validated on behalf of the Mini
19. ncellation the performance bond is subject to forfeiture and the required funds shall be used to clean up and restore all park lands affected After the restoration of park lands has been accomplished to the satisfaction of the Parks Branch surplus monies shall be returned to the former Permittee Adequate bonding requirements at the present time shall be set at the following rates l Basic amount 10 000 1 5 acres 2 Area used over 5 acres 2 000 acre Bonding requirements shall be subject to negotiation or from the basic amount depending upon the extent of environmental impact on the Park lands concerned Performance bonds shall be required for all industrial exploitation which utilizes park lands for the following 1 Construction of new roads 2 Camps and industrial sites 3 surface disturbance in the course of mineral exploration and development etc 4 dumping of tailings and other effluents For very minor exploration work on mineral claims bonding may not be required The Park Use Permit can be used as a lever to accomplish all restoration required In the event of insufficient bonding Section 3 Park Act Regulations states the following in the event that no or insufficient security is depostted any expense to the Crown in right of the Province incurred in making such repairs ts a debt owing to her Majesty the Queen in right of the Province by the ouner involved and is recoverable at the suit o
20. shall receive the following notice i one 1 year s notice for closure by Fish and Wildlife Branch or ii three 3 years notice for closure by Parks Branch c In the event of the closure of trapping of a certain species by Fish amp Wildlife or Parks the trapper concerned shall receive one 1 year s notice All Special Use Permits and Land Use Permits issued under the provisions of the Forest Act or the Land Act for cabins used for trapping shall be transferred to the Parks Branch and authorized by a Park Use Permit The locations and construction of all trails contemplated by trappers within Parks shall be approved and authorized by the Director Parks Branch Provisions of the Wildlife Act and Park Act shall be binding on all trappers within Provincial Parks Where there is conflict between the Wildlife Act and the Park Act the provisions of the Park Act shall prevail a Contravention of the Wildlife Act by the trapper shall void the trapping operation within the Park and the trapping license and Park Use Permit shall be cancelled subject to appeal as provided for b Contravention of the Park Act or Park Use Permit conditions by the trapper shall void the trapping operation within the Park and the Park Use Permit and trapping license shall be cancelled subject to appeal as provided for Dr J Hatter T E Lee Director Director Fish amp Wildlife Branch Parks Branch Approved Minister of Recreation amp Conser
21. ster of Recreation and Conservation and copies distributed as follows i the permittee original ii Victoria Headquarters files iii Regional Manager iv District Superintendent e Upon issuance new permits shall be treated as existing permits Copies of the permits forwarded to the Regional Manager and District Superintendent shall be xerox copies of the valid signed permits 5 Es Renewal of existing Park Use Permits If it is necessary or desirable that the privilege granted by a Park Use Permit continues beyond the date of expiry a new permit perhaps incorporating new terms or conditions must be issued The following procedure will be followed in respect to the re issuance of Park Use Permits a c Park Use Permits expire at the end of the period for which they are issued and it is the permittee s respon sibility to reapply to the Parks Branch for the con tinuation of all Park Use Permits one 1 month before the expiry date of the Permit To be a condition of all permits If no application of renewal is received one 1 month prior to date of expiry the Parks Branch on that date will forward a letter advising the Permittee to reapply for the Permit within 30 days from the date of the letter If the Permittee has not reapplied for the continuance of a permit within the 30 days the Parks Branch will notify the individual by Double Registered letter that the Permit has been c
22. t acquire the privileges granted to another by a Park Use Permit by merger With the passage of time a Park Use Permit especially for cabins is equated with an interest in land and our Permittees consider the privileges a part of an estate and hence saleable To counter this belief we must endeavour to inform Permittees of the restrictions pertinent to their permits In summary it is the objective of the Parks Branch to minimize the number of Park Use Permits and the wide range of activities presently authorized except the ones which contribute to public enjoyment of approved activities in our parks It is evident at this time that because of existing alienations more non conforming operations i e mineral exploration or development will have to be accommodated within Provincial Parks and if these activities are to be controlled by the Parks Branch strict attention to the issuance and administration of Park Use Permits is imperative Issuance of Park Use Permits Authority to Issue Section 24 1 of the Park Act states The Minister or his authorized agent may subject to the provisions of thts Act and upon payment of such fees as may be fixed by the Lieutenant Governor in Council issue a park use permit authorizing upon such terms and conditions as he may prescribe a person or persons to do any one or more thing or things for which under this Act a park use permit is required A park use permit is required for all us
23. ter shall determine if the Permit will be modified or cancelled Termination or cancellation of all valid and subsisting Permits may be effected by the Director only with the approval of the MINISTER III LETTERS OF AUTHORITY A Letter of Authority as defined in Provincial Park Regulations means a letter written by a person authorized by the Minister to do so authorizing the addressee to perform a specified act or acts otherwise prohibited by regulation Park Act Regulations are quite specific in definition in that letters of authority can only authorize activities or uses which are prohibited by regulations as set by said regulations Letters of Authority cannot countermand the requirements of the Park Act only Park Use Permits can modify the Act as authorized by the Act Issuance of Letters of Authority A Letters of Authority can be issued by the Regional Managers as per Statement of Policy Section IV B with exception to the following which will be issued by Management Division 1 scientific research collections etc 2 activity involving two or more regions 3 advertising B All Letters of Authority should contain the following specific information 1 where the activity takes place 2 description of designated activity authorized 3 date of commencement and termination of activity 4 number of people involved i e group camping 5 equipment or vehicles i e registration number of snowmobil
