Our Remedy In the event of a breach of this Agreement by you in addition to the right to immediately terminate this Agreement and revoke the License we shall be permitted to pursue all other remedies available to us to protect the integrity of the Software and Documentation pursuant to law and equity including but not limited to injunctive relief Termination Except as otherwise set forth herein this Agreement and the License granted herein shall remain in effect until terminated by you You may terminate this Agreement and the License at any time by providing proof to us that you have destroyed all copies of the Software and Documentation in your possession This Agreement and the License granted herein shall also automatically terminate if you fail to comply with any term or condition of this Agreement Upon termination of this Agreement you must either return to us or destroy and provide proof of the same all copies of the Software and Documentation in your possession Confidentiality The Software contains trade secrets and proprietary know how that belong to us and it is being made available to you in strict confidence ANY USE OR DISCLOSURE OF THE SOFTWARE OR OF ITS ALGORITHMS PROTOCOLS OR INTERFACES OTHER THAN IN STRICT ACCORDANCE WITH THIS LICENSE AGREEMENT MAY BE ACTIONABLE AS A VIOLATION OF OUR TRADE SECRET RIGHTS General Provisions 6 Page 2010 tailoredPOS TailoredPOS Integrated Gift Card Module for Dinerware

10. er Guide V 2 x e make one or more copies of the Software solely for backup or archival purposes and or e transfer the Software to additional computers so long as it exists within the limitations of the License Things You May Not Do The Software and Documentation are protected by United States copyright laws and international treaties You must treat the Software and Documentation like any other copyrighted material You may not and legal action will be constituted against you if you e copy the Documentation e copy the Software except to make archival or backup copies as provided above e modify or adapt the Software or merge it into another program e reverse engineer disassemble decompile or otherwise make any attempt to discover the source code of the Software e place the Software onto a server so that it is accessible via a public network such as the Internet or e sublicense rent lease or lend any portion of the Software or Documentation to any person or entity not a party to this Agreement Transfers Neither the License nor this Agreement is transferrable or assignable You may not resell or otherwise transfer the Software or the License Rentals You may not rent lease or lend the Software or License Support Services Back up We are under no obligation to provide support services for the Software However if we do provide such services any supplemental software code provided to you as part of the support se
11. he gift card system was designed to have cards preloaded into the system and all instructions that follow are based on having those cards preloaded in the system before you begin activating and redeeming them The system does have the option to not validate a card number as being preloaded however we highly recommend against using that feature and as such do not provide instructions on how to operate in that mode We assume that for the following instructions you have logged into a Dinerware workstation entered into Manager and clicked on the Gift Cards button at the bottom right of your screen Activate Add Value to a Card Activating and Adding Value to a gift card is the same process and is grouped within the same Activate Add Value button on the screen In order to either reactivate or add value to a particular card you will want to look through the list of available cards highlight the row that corresponds with the card you wish to reactivate and click on the Activate Add Value button at the bottom of your screen If you do not wish to add any additional value to the card simply press OK in the window that appears and you will have the card reactivated If you wish to add additional value to the card you may either enter it in the Amount to Add text Box or click on the ellipsis button next to the text box and punch in the new value you wish to add to the card and then press OK Change a Card s E
12. lation and Setup Prerequisites 1 The lastest release of Dinerware 3 x 2 The gift card setup msi You should be provided with a download link when you receive your license file from tailoredPOS Before You Begin Please make sure that you have properly setup and configured Dinerware Dinerware Basics before you begin It is strongly recommended to make a backup of the working database and to deploy the provider during closed hours for the restaurant Failure to follow any of these warnings may result ina corrupt database and difficulties in supporting the product for the end user You will want to exit Dinerware Brain and Dinerware Workstation on all machines in your establishment before you begin Failure to do so may result in configuration issues Installation This document is based on setup of Dinerware 3 0 3 on a Windows Vista machine All references to configuration options may need to be altered to match your version of Dinerware or Operating System Begin setup by double clicking the msi file and answering yes to begin installation After reading and accepting the EULA you will be prompted to choose an installation folder If you are installing in Dinerware 3 0 you may keep the defaults Any other version of Dinerware 3 you must select the correct folder where Dinerware is installed on your machine Once the installation folder is selected you will simply click through the screens and allow the msi to install the software on y

14. rvices shall be considered part of the Software and subject to the terms and conditions of this Agreement With respect to technical information you provide to us as part of the support services we may use such information for its business purposes including for product support and development We will not utilize such technical information in a form that personally identifies you You are solely responsible to back up the data and Software every day We shall have no liability of any kind as a result of any data lost due to your failure to back up the data and Software on a daily basis THE SOFTWARE CONTAINS A MANUAL BACK UP THIS DOES NOT HAPPEN AUTOMATICALLY you must perform the steps as outlined below in order to back up the data and Software that you can perform each day the steps are set forth below You can choose this back up procedure to back up the Software 4 Page 2010 tailoredPOS TailoredPOS Integrated Gift Card Module for Dinerware User Guide V 2 x and data or you can choose another program or software package to install to utilize as your back up protocol These are recommendations only they in no way extend liability to us for your failure to follow them or if you do use them and a failure still occurs MANUAL BACK UP 1 Log into Dinerware using your personal pin code or manager card 2 Click on Manager 3 Click on Gift Cards 4 Click on Backup Cards 5 A browse folder dialog box will appear 6 Sel
15. t to keep the expiration date s in the original CSV file and title that column as ExpirationDate The final step is to do a File Save As You can use the Office Button and Choose Save As Other Formats Choose CSV as your file type and save the file Import into the Provider The task of importing gift cards can be performed at any workstation with just a few touches on the screen Assuming you have already logged into any Dinerware workstation entered Manager and have pressed the Gift Cards button you should next press the Import Cards button on the left hand side of the screen You are presented with a similar interface as your main management screen but this is specifically to handle the importing of cards into the system You will next click on the From File button and navigate into the folder or usb thumb drive where you saved the CSV that you created earlier and open the file If all works as expected your screen will have 15 Page 2010 tailoredPOS TailoredPOS Integrated Gift Card Module for Dinerware User Guide V 2 x a listing of the new card numbers you wish to import Should this error out open the CSV file in notepad and verify the format of the columns the capitalization etc Once you have validated the imported data on the screen go ahead and click the Commit Import button on the screen to complete the importing of the cards into the system Managing Gift Cards T
16. ta tailoredPOS Dinerware Gift Cards Consider any folders and files inside of the above mentioned folder to be an important file that should be backed up You may either use a daily batch file that moves the data inside of the above folder offsite or you can subscribe to one of the many offsite backup service providers such as iBackup Carbonite etc and follow their directions on proper setup and usage of their backup services Importing Gift Cards Supported Encodings The general rule of thumb with regard to the encoding of a magnetic card stripe is that if the card can be used with your existing card processor and you are converting over to our in house solution you are capable in using your existing cards with our solution The DW Payments Engine 2 9 handles parsing the magnetic stripe before we begin processing the gift card If you wish to find out if a particular card is capable of being processed our gift card solution is built to run a maximum of five 5 cards without the need of a license This should allow you to evaluate the solution in full detail before you make any decision To go further into detail on the different supported encodings of the system Dinerware has provided several existing card formats that have been successfully used in the past All data here is direct from the cards without any special formatting Existing Processor Card Data Mercury Payment 77359800380 550110128 Systems Paymentech B60357101209300

18. ubmitted payment in full for the Software and Documentation as set forth below in the Features Price and Payments section of this Agreement we grant you the following rights e The right to use of the Software and Documentation in accordance with the terms of this Agreement the License Title We remain the sole owner of all right title and interest in the Software and Documentation Features Price and Payments The price for the Software shall be in accordance with the current rates in place at the time in which you place your order and will be based upon the desired features therein The Software and Documentation will be forwarded to you and the term of the License will commence upon receipt in full by us of the amount set forth on the invoice for the Software and Documentation please allow an additional ten 10 days if payment is made by check If for any reason the Software and Documentation are received by you prior to full payment being made we reserve the right to suspend the License until payment in full is received by us If full payment is not made within thirty 30 days notice from us to you that we have not received the same we reserve the right to immediately terminate this Agreement and revoke the License The License and Agreement can be reinstated by us upon full payment from you Archival or Backup Copies You may 3 Page 2010 tailoredPOS TailoredPOS Integrated Gift Card Module for Dinerware Us
