Protocol are still unclear to us and require further investigation and study     Ghana  The current position of the Ghana Government in respect of the Protocol is as follows     1  Cabinet has given approval for Ghana to ratify the Protocol     UNEP CHW OEWG 2 3    2  A request has been sent to Parliament to endorse Cabinet   s decision that Ghana ratifies the  treaty  The relevant committees of Parliament have met and would soon place the Protocol  before the House of Parliament for its approval  It is expected that the various processes  would be completed before the next COP     Turke    The Protocol on Liability and Compensation has been considered positively by the Ministry of  Environment and Forestry and the legal procedures for accession are underway     4  The Protocol has been examined by the respective national authorities and not recommended  for ratification accession  If possible and in general terms  please specify the reasons why it was not  recommended for ratification accession     Canada    Canada has not initiated any steps for possible accession to the Liability Protocol  The Protocol has  however been examined by the respective national authorities in order to determine what domestic actions  would be needed  were we to initiate accession  For Canada  acceding to the Protocol would require  legislative and or regulatory changes that would require decisions by the federal and provincial governments   Initial consultation with stakeholders  the Provinces

9. mposici  n abierta lo examine en su tercer per  odo  de sesiones con miras a presentarlo ante la Conferencia de las Partes en el Convenio de Basilea en su  s  ptima reuni  n     UNEP CHW OEWG 2 3    Anexo       COMPILATION OF THE VIEWS AND COMMENTS RECEIVED FROM PARTIES ON THE  QUESTIONNAIRE ON DECISIONS VI 15       The following comments are verbatim excerpts of the responses from Parties to the Questionnaire     1  No steps have been taken towards ratification accession    in general terms would you elaborate why no action has been taken    Andora    The Principality of Andorra is undergoing drastic changes related to waste management  At the  moment  the bill on waste management is about to be discussed at the parliament  the local authorities are  designing systems of selective collection     Andorra is still busy with setting up the system of transboundary movements of hazardous wastes  and other wastes  For example  Andorra has been finding obstacles to use the Basel Convention forms for  the notification document  as well as for the movement document  Plus  the Department of Environment   responsible for the Waste issues  has been facing a huge crisis on dioxins and the former waste incinerating  plant  and that since October 2002     Therefore  the priority for the Department of Environment is on domestic issues  such as  a  clearly  define the legal domestic framework  b  set up the national waste management system and the re use and    recycling schemes     The stud
10. ol  Some issues could be solved  easily by issuing the new regulation under the main law  some issues should be carefully reviewed and  amended the main laws  which need time to achieve it  while some issues have affected the national  jurisdiction court  which difficult to comply with  Additionally  paragraph 2 of Annex B of the Protocol  regarding the Limits of Liability may be amended at COP6  Therefore  the sub committee has decided to  postpone the examination of the regulations or any necessary arrangements for the ratification accession and  implementation of the Protocol until having the decision of COP6 on the Protocol matters  Consequently   the difficulties and obstacles for implementation and ratification of the Protocol as well as the way forwards  would be consulted and considered again in the Basel Sub committee     2  No formal steps have been taken towards ratification accession but the Protocol has been  examined by the respective national authorities in order to determine what actions may be needed to  initiate ratification accession     in general terms  can any preliminary outcomes be shared with other  Parties to the Convention    Belarus    The Protocol on liability and compensation for damage resulting from transboundary movements of  hazardous wastes and their disposal is being examined by the Ministry of Natural Resources and  Environmental Protection of the Republic of Belarus  responsible body for the implementation of Basel  Convention  It has not

12. senta un resumen de las respuestas a los formularios     a  Siete Partes informaron a la secretar  a que no se hab  an adoptado medidas oficiales respecto  de la ratificaci  n y o adhesi  n  No obstante  tres de esas siete Partes informaron de que se hallaban en el  proceso de adoptar medidas o de examinar el asunto con diferentes interesados directos  Una Parte inform    a la secretar  a que durante el examen del Protocolo hab  a determinado que varias cuestiones en el Protocolo  a  n no recib  an atenci  n en sus leyes y reglamentaciones nacionales  en particular las cuestiones relativas a  seguros y garant  as financieras  l  mites financieros  l  mites de responsabilidad y el reconocimiento y  aplicaci  n mutuos de dict  menes  Esas cuestiones planteaban dificultades y obst  culos a la Parte en relaci  n  con la ratificaci  n del Protocolo     b  Tres Partes informaron a la secretar  a que el Protocolo hab  a sido objeto de examen por sus  autoridades nacionales y que hab  a sido recomendado para su ratificaci  n y o adhesi  n     c  Una Parte inform   a la secretar  a que el Protocolo hab  a sido examinado por sus autoridades  nacionales para determinar las medidas de car  cter nacional que ser  a preciso adoptar si la Parte iniciaba el  proceso de adhesi  n  Para esa Parte  adherirse al Protocolo precisar  a de la promulgaci  n de leyes y o la  adopci  n de cambios reglamentarios a los niveles federal o provincial  La misma Parte indic   que las  consultas iniciales rea
