3. any former member of the firm any liability under contract No new partner partners shall be accepted into the firm by the contractor in respect of this contract unless he they agree to abide by all its items condition and deposit with the Director Health Services SI Punjab and written agreement to this effect The contractor receipt of acknowledgement or that of any partner subsequently accepted as above shall bind all of them and will be sufficient discharge for any of the purpose of the contract The contractor will supply only genuine machinery as described in column 2 of Schedule A from time to time in such quantities in column 3 of scheduled A for use of office institution s Departments under Administrative control of the Directorate But the tenderers must undertake to supply the quantities mentioned in the list required by Director Health Services SI Punjab reserve to himself the right of placing the contract with one or more contract as he may think fit and consideration of this undertaking by Government the contractor blind himself not to revoke this contract during the said period The articles to be supplied under this contract must be as per specifications laid down against each machinery and equipment The contractor shall be responsible for all complaints as regards to the quality In case of dispute regarding quanlity of articles and breach of the terms and conditions of the contract the decision of

7. shall be removed by the contractor at his own expenses If during the currency of the contract the specifications of any articles or articles to be supplied under be changed the contract shall continue to comply with demand for the supply of the said articles in accordance with the new specifications at a rate to be mutually agreed to in writing at the time of such change and in default of such agreement the contractor is so far as it related to the said article or articles in respect of which no agreement has been arrived at shall terminate but no such change shall effect the supply of any other articles under the contract or entitle the contract to any compensation In the event of withdrawn or discontinuance of any articles and consequent ceasing of or reduction in demand and the contract shall not be entitled to any compensation Government will however make all reasonable endeavours to give warning of any impending complete withdraw or any reduction seriously effecting quantities likely to be required under the contract The time for and date of delivery or dispatch stipulated in supply order shall be deemed to the essence of the contract and should the contractor fails to deliver or dispatch any consignment within the period prescribed for such delivery or dispatch stipulated in the supply order the delayed consignment will be subject to 2 penalty per consignment as per provisions contained in store purchase Rules of Punjab Govt How
8. the Director Health Services SI Punjab shall be final and binding on the contractor It shall be open to the Director Health Services SI Punjab to send samples submitted by the tenderers contractors to any laboratory for analysis or report and the cost thereof will be borne by the tenderers contractor The Director Health Services SI Punjab may by notice in writing call upon the contractors to supply addition articles to service as samples and upon such notice in writing the contractor shall at his own be bound to supply additional samples such being in all respects of the same quality as the samples first supplied The contractor shall be responsible for damage or loss in transit and replace goods broken or lost within 10 days from the date of the notice thereof Unless when specially ordered otherwise in the order accompanying the indent all goods must be dispatched within 4 weeks of the issue of the purchase order to the contractor Conditions as to the time for supply whether laid down herein or in any indent shall always be regarded as the essence of the contract The Director Health Services SI Punjab or any representative of any of the experts authorized by the Director Health Services SI Punjab or the INDENTING OFFICER or any other person duly authorized in writing by the Director Health Services SI Punjab shall have the power to inspect the stores before during or after manufacturing collection disp

19. aking the tests elsewhere The contractor shall also provide any delivery free of charge at such place as the aforesaid officer may direct such material as he may be required for tests by chemical analysis or independent testing 10 11 12 machine If for the purpose of determining the quality of stores the aforesaid officer finds it necessary to have the stores tested at the test house or laboratory expenses incidental to the test shall be borne by the contractor On failure if the contractor to pay the expenses within 10 days of the receipt of intimation in this behalf from inspecting officer the Director Health Services SI Punjab shall have the right to direct him them contractor s to deposit the said amount and if the same is not deposited within 10 days the Director Health Services SI Punjab may target the default as breach of the agreement and proceed under clause I or the agreement Schedule B without further notice Further the aforesaid officer shall have the right to put articles or materials to such tests as he may think proper for the purpose of ascertaining whether the same are in accordance with the specifications of sealed samples mentioned in the tender and to cut or off or destroy an portion not exceeding 2 from each delivery for such purposes The quality so cut out or off and or destroyed as aforesaid shall be replaced by the contractor free of charge Packing cases containers gunny packages etc
20. atch transit or arrival and reject the same or any part of portion after the written approval of the Director Health Services SI Punjab If he or they are not satisfied that same is not equal or according to the samples submitted by the contractor the contractor shall not charge or be paid for supplies rejected as above and such supplies shall be removed by the contractor at once at his own expenses He shall neither claim to be entitled to any payment for any damage caused due to the rejected supplies and whatsoever incidental to a full and proper examination and test of such supplies Director Health Services SI Punjab shall be removed by the contractor s risk Rejected supplies shall be removed by the contractor within 10 days after notice has been issued to him of such rejection and failing such removal the rejected goods shall be at contractor s risk Government may charge rent from the contractor for the space occupied by such rejected goods if lifted beyond the period specified The contractor shall provide without any extra charge all materials tools labour and assistance of every kind which the aforesaid officer may consider necessary for any test or examination which he may required to be made on the contractor s premises at his own cost the maker shall provide all facilities including testing appliances for making necessary test other than special test or independent tests Failing the facilities at his own premises for m
