3. 12 2 Duraci n e inicio de la garant a 12 2 1 Este compromiso excepci n hecha de una dis posici n concreta al respecto s lo se aplica a los fallos que surjan durante un per odo de 12 meses periodo de arant a 2 2 2 El per odo de garant a empieza a contar a partir de la fecha de entrega seg n lo establecido en los p rrafos 4 1 42 y 44 anteriores 12 2 3 La reparaci n modificaci n o sustituci n de una pieza durante el per odo de garant a no supone en ning n caso la prolongaci n del plazo de garant a del material 12 3 Obligaciones del comprador 12 3 1 Para poder beneficiarse de tales disposiciones el comprador est obligado a notificar el fallo al vendedor por medio de una carta certificada con acuse de recibo y en el plazo de ocho d as a partir del momento en que se ha descubierto dicho fallo y a proporcionar todo tipo de informaciones que justfiguen la existencia de dicho fallo 12 3 2 Asimismo deber ofrecer al vendedor todo tipo de facilidades que le permitan constatar dichos fallos y su correcci n Adem s deber abstenerse de realizar personalmente la reparaci n o encargarla a un tercero salvo acuerdo expreso con el vendedor siempre que dicha acci n no est encaminada a adoptar las medidas de conservaci n indispensables 12 3 3 El comprador no podr apelar al recurso de garant a en los casos de suspensi n o retraso de los pagos 12 5 Da os Intereses La responsabilidad del vend

5. 12 2 1 Wenn nicht anders vereinbart erstreckt sich diese Vereinbarung nur auf M ngel die w hrend einer Periode von 12 Monaten auftreten Garantiezeit 12 2 2 Die Garantiezeit beginnt mit dem Lieferdatum im Sinne der Paragraphen 4 1 4 2 und 4 4 siehe auch die vollst ndigen Allgemeinen Gesch ftsbedingungen des Verk ufers 12 23 Reparatur Anderung oder Ersatz eines Teiles hat in keinem Falle eine Verl ngerung der Garantiezeit der Ware zur Folge 12 3 Verpflichtungen des K ufers 12 3 1 Um in den Genuf der vorstehenden Garantieleistungen zu kommen muf der den Verk ufer per Einschreiben mit R ckschein vor Ablauf einer Frist von acht Tagen ab der Entdeckung des Fehlers benachrichtigen und alle Beweise ber das Bestehen desselben liefern 12 3 2 Er muB ihn bei der Feststellung und der Behebung des Fehlers in jeder Hinsicht unterst tzen Er verpflichtet sich auBer zur Verhinderung weiterer Sch den selbst keinerlei Reparaturen durchzuf hren oder von Dritten durchf hren zu lassen es sei denn mit der ausdr cklichen Zustimmung des Verk ufers 12 3 3 Der K ufer kann seine Zahlungen unter dem Vorwand seiner Garantieforderungen weder aussetzen noch verschieben 12 5 Schadenersatzanspr che Die Verantwortung des Verk ufers ist ausschlieBlich auf die vorstehend definierten Verpflichtungen begrenzt und es gilt als ausdr cklich anerkannt daB er keinerlei weitere Verg tungen zu leisten hat Insbesond
