1. No Other Express Tacit Verbal or Written Warranties or Agreements 16 This warranty grants Taiga Zone s customers particular rights as detailed in this document Beyond these Taiga Zone does not provide any other express tacit verbal or written warranties Taiga Zone and the Customer agree that this document includes all warranty terms and conditions and that no other written verbal or implicit agreements regarding the warranty were discussed or made by Tr vi and the Customer Imp_jan 2011 modifi e le 11 oct 2012 Warranty Transfer 17 This warranty may be transferred to any new buyer of the property on which the pool is located provided that a technical inspection performed by Taiga Zone determines the pool s soundness The cost for the inspection and starting a new file shall be paid in advance by the Customer and is not reimbursable NOTE The underlining of words in the section headings is intended strictly to facilitate the reading of this document and shall not be interpreted in any other way APPENDIX 1 AMORTIZATION SCHEDULE FOR THE COST OF MATERIALS USED UNDER SECTION 9 OF THE WARRANTY Warranty year Parts a to n Parts a to n Amortized value Non amortized value Imp_jan 2011 modifi e le 11 oct 20122. 3. garantie 5 Lorsque l analyse de la situation dont il est fait tat la section no 4 conclut qu une r paration pour corriger un D faut de Fabrication d une Composante doit tre effectu e et lorsque telle r paration est entreprise au cours des deux premi res ann es de la garantie telle r paration la Composante ayant un D faut de Fabrication et seulement la r paration cette Composante sera enti rement la charge de Ta ga Zone R paration d un D faut de Fabrication d une Composante effectu e entre le d but de la 3 ann e de la garantie et la fin de la derni re ann e de la garantie 6 Lorsque l analyse de la situation dont il est fait tat la section no 4 conclut qu une r paration pour corriger un D faut de Fabrication d une Composante doit tre effectu e et lorsque telle r paration est entreprise entre le d but de la 3 ann e de la garantie et la fin de la derni re ann e de la garantie le co t de la main d uvre sera enti rement la charge du Client tandis que le co t des mat riaux sera r parti entre Ta ga Zone et le Client de la mani re pr vue la section no 9 Ta ga Zone remettra au Client un devis de co ts indiquant les co ts de la main d uvre et du mat riel requis pour effectuer la r paration du D faut de Fabrication dont il est fait tat dans cette section La section no 8 fait tat des paiements exig s du Client lorsqu il a sa charge la totalit ou une partie des co ts d

Damage caused by the settling of the soil outside the pool s perimeter o Damage caused by the pressure exerted by the winter blanket or its fastening system p If Taiga Zone is unable to provide the requested assistance after receiving service calls made late in the fall when the weather makes such requested assistance impossible Taiga Zone shall in no way be held liable for damages resulting from Taiga Zone s inability to respond q Damage caused by the presence in the ground or elsewhere of pollutants or contaminants in any form regardless whether they are solids liquids gases microorganisms odours heat vibrations radiation or any combination of these elements r Damage caused by a utility service s failure to supply gas water or electricity Compensation for Damage to Other Property 13 Compensation is excluded for any damage caused to property other than that governed by this warranty Supply of Water and Chemical Products 14 Taiga Zone shall not assume the costs for the supply of water and chemical products including salt when installing the pool and shall not assume such costs if it is necessary to refill a pool that needed to be emptied to perform inspections maintenance or repairs Other Conditions Affecting the Warranty 15 The warranty is suspended during the period in which the Customer is in default on debts owed to Tr vi and will remain suspended as long as said debts have not been settled in full
5. 6. damage and deterioration described in Section 12 which are not the result of Manufacturing Defects of the Parts are excluded from the parts warranty and in no way impose any liability on Taiga Zone Imp_jan 2011 modifi e le 11 oct 2012 Ta ga Zone Warranty Period for Manufacturing Defects in Parts 3 The Ta ga Zone warranty against Manufacturing Defects enters into effect on the purchase date indicated on the purchase contract and expires at the end of the 15 year following the purchase date Once the warranty has expired Taiga Zone is released from all liability for the damage wear repair and replacement of Parts and the Customer shall assume all costs pertaining to repairs and replacements of Parts regardless of the causes and circumstances requiring said repairs or replacements Notification of Possible Manufacturing Defects in a Part 4 It is imperative that the Customer notify the retailer who sold the pool hereinafter referred to as the Retailer promptly and in writing of any anomalies or peculiarities the Parts may exhibit that could indicate possible Manufacturing Defects and provide him with a detailed description and supporting photos of the anomaly or peculiarity observed The Retailer must receive this notification no later than two weeks after the first appearance of the anomaly or particularity Any delays in notification will void the warranty or reduce its scope Upon receiving the detailed description a
7. the Customer s share of material costs established as per Section 9 Upon completion of repairs the Customer shall immediately pay Taiga Zone an amount equivalent to the other half of the labour costs and the other half of the Customer s share of the material costs Allocation of Costs for Materials Used in the Repair of Manufacturing Defects in Parts Performed Between the Start of the Third Year of the Warranty Period and the End of the Last Year of the Warranty 9 The cost of materials used to repair Manufacturing Defects of Parts between the start of the 3 year and the end of the last year shall be divided between the Customer and Taiga Zone as follows for each Part repaired the Customer s share will correspond to the cost of materials as indicated in the cost estimate referred to in Section 6 multiplied by the percentage representing the amortized value of the Part to be repaired while Taiga Zone s share will correspond to the cost of materials as indicated in the cost estimate multiplied by the percentage representing the Part s non amortized value The amortization schedule for material costs Appendix 1 indicates the years of the warranty period in which repairs are performed and the percentages corresponding to the amortized and non amortized values of the Parts The Repair of Manufacturing Defects Does Not Result in an Extension of the Warranty Period 10 The repair of Manufacturing Defects in Parts does not result in

9. cture de la piscine i Les gratignures d colorations ondulations fissures et r tr cissements r sultant du comportement normal et de l usure normale des mat riaux ne sont pas des dommages qui justifient le remplacement des Composantes j La d gradation de la piscine ou de sa fondation caus e par les racines des arbres existants soit sur la propri t du Client soit sur une propri t voisine k La d gradation de la piscine ou de sa fondation caus e par la pr sence dans le sol de souches ou autres objets I Les dommages occasionn s par un fond de sable qui pr sente des bosses des trous ou des tranch es pratiqu s par des vers de terre ou des fourmis et en g n ral tous les dommages caus s par les animaux et insectes nuisibles tels mais sans limiter la g n ralit les rats souris cureuils ratons laveurs oiseaux vers et fourmis m Les dommages occasionn s par le poids de la neige ou de la glace accumul e sur la piscine n Les dommages occasionn s par l affaissement du terrain hors du p rim tre de la piscine o Les dommages occasionn s par la pression exerc e par la toile d hiver ou le syst me d attache de cette toile p Advenant que Ta ga Zone soit incapable de donner suite des appels de service re us tardivement en automne alors que le temps rend impossibles les interventions demand es les dommages r sultant d une telle incapacit de Ta ga Zone n engagent nullement la responsabilit d
10. e Taiga Zone q Les dommages occasionn s par la pr sence dans le sol ou ailleurs de polluants ou de contaminants sous quelque forme que ce soit qu il s agisse de mati res solides liquides ou gazeuses de micro organismes d odeurs de chaleur de vibrations de rayonnements de radiations ou de toute combinaison de ces l ments r Les dommages occasionn s par le d faut d un service public d assurer l alimentation en gaz eau ou lectricit Indemnisation de dommage un bien autre 13 Est exclue l indemnisation de tout dommage caus un bien autre que celui faisant l objet de la pr sente garantie Adduction d eau et de produits chimiques 14 Ta ga Zone n assume pas les co ts d adduction d eau et de produits chimiques y compris le sel lors de l installation de la piscine et n assume pas non plus de tels co ts s il est n cessaire de remplir une piscine qu il a fallu vidanger pour effectuer des v rifications de l entretien ou des r parations Autres conditions affectant la garantie 15 L application de la garantie est suspendue tant que le Client a des obligations financi res en souffrance envers Ta ga Zone et reste suspendue tant qu il ne s est pas acquitt compl tement desdites obligations financi res Aucune autre garantie ou entente expresse tacite verbale ou crite 16 Cette garantie conf re aux Clients de Ta ga Zone des droits particuliers pr cis s dans ce document et sauf ceux ci
11. e main d uvre et des co ts de mat riel Imp_jan 2011 modifi e le 11 oct 2012 Travaux autres que ceux exig s par la r paration d un D faut de Fabrication d une Composante 7 Advenant que la r paration d un D faut de Fabrication une Composante r paration dont il est fait tat aux sections no 5 et no 6 exige le d placement la modification et la r paration de constructions de terrassement d am nagement paysager de Composantes autres que celles pr sentant un D faut de Fabrication d appareils ou autres dispositifs le co t de tels d placement modification et r paration sera enti rement la charge du Client Sur demande du client Ta ga Zone dressera un devis du co t de tels d placement modification et r paration La section no 8 fait tat des paiements exig s du Client lorsqu il a sa charge le co t de tels d placement modification et r paration Paiements exig s lorsque le Client a sa charge une partie du co t des travaux n cessaires pour la r paration d un D faut de Fabrication une Composante 8 Lorsque comme il en est fait tat aux sections no 6 et 7 le Client a sa charge le co t de la main d uvre et la totalit ou une partie du co t des mat riaux requis pour la r paration d un D faut de Fabrication une Composante le Client versera Ta ga Zone avant le d but de la r paration un montant gal la moiti de la somme du co t de la main d uvre a sa char
12. ge plus la moiti de sa part du co t des mat riaux tablie de la mani re pr vue la section no 9 la fin de la r paration le Client paiera imm diatement Ta ga Zone un montant gal l autre moiti du co t de la main d uvre plus l autre moiti de sa part du co t des mat riaux R partition du co t des mat riaux utilis s dans la r paration d un D faut de Fabrication d une Composante effectu e entre le d but de la troisi me ann e de la garantie et la fin de derni re ann e de la garantie 9 Le co t des mat riaux utilis s dans la r paration d un D faut de Fabrication d une Composante effectu e entre le d but de la troisi me ann e de la garantie et la fin de la derni re ann e de la garantie sera r parti entre le Client et Ta ga Zone comme suit pour la Composante r parer la part du Client correspondra au co t des mat riaux indiqu au devis de co ts dont il est fait tat la section no 6 multipli par le pourcentage qui repr sente la valeur amortie de la Composante r parer tandis que la part de Ta ga Zone correspondra au co t des mat riaux indiqu au devis de co ts multipli par le pourcentage qui repr sente la valeur non amortie de la Composante Le tableau qui suit l annexe no 1 indique pour ce qui a trait aux co ts des mat riaux les ann es de la garantie durant lesquelles la r paration est effectu e et les pourcentages qui correspondent la valeur amortie et
13. her over the stones because too much water or humidity in contact with wood will damage it over time Put the stone or river pebbles around the pool as above mentioned and make sure the stone have a slight slope which will ensure that water flows in the opposite direction from the pool f Damage resulting from winterizing the pool prior to the end of September or turning off the filtration system before winterizing the pool g Damage caused to pool resulting from not checking the watertightness of the liner when winterizing the pool and if applicable failing to repair all leaks in the liner prior to winterizing the pool h Deterioration resulting from normal wear and tear blackening and greying of the pool structure i Scratches discoloration buckling cracks and shrinkage that result from normal wear and the normal behaviour of the materials are not damages that justify replacing the Parts j The deterioration of the pool or its foundation due to existing tree roots on the Customer s property or neighbouring lots k The deterioration of the pool or its foundation due to the presence of stumps or other objects in the ground I Damage caused by a sand bottom that has bumps holes or furrows created by ants or worms and generally any damage caused by pests and vermin such as but not limited to rats mice squirrels raccoons birds worms and ants m Damage caused by the weight of accumulated snow or ice on the pool n
14. lumns g seat caps h strap supports i panel clips j metal reinforcements k steel sections I straps m bolts and n all other pool parts This general warranty statement pertaining to Taiga Zone pools does not include the pool installation warranty which is the responsibility of the installer in the event that the installer is hired by the buyer of the pool hereinafter referred to as the Customer Likewise this warranty does not include warranties pertaining to any equipment or accessories that may be acquired by the Customer such as the pool liner pump water heater filter pipes and various related parts skimmer water return diversion valve and other equipment and accessories The warranties for equipment and accessories acquired by the Customer are the responsibility of the manufacturers of such equipment and accessories The Customer must address any claims for covered items to the respective manufacturer Taiga Zone Parts Warranty 2 For the purposes of this warranty pertaining to the Parts described in Section 1 manufacturing defects hereinafter referred to as Manufacturing Defect or Manufacturing Defects are those that i seriously impair the quality safety or use of the pool or ii render the pool unsuitable for its intended purpose or severely diminish its utility or iii adversely affect a critical Part such that the stability of the structure is compromised However the instances of
15. ment Taiga Zone shall submit to the Customer a cost estimate for materials and labour needed to repair the Manufacturing Defects in Parts described in this section Section 8 describes the payments to be assumed by the Customer when liable for all or a share of labour costs and material costs Work Other than that Required by the Repair of a Manufacturing Defect in a Part 7 In the event that the repair of a Manufacturing Defect in a Part as detailed in Sections 5 and 6 requires travel the modification and repair of structures earthwork landscaping Parts other than those presenting a Manufacturing Defect equipment or other devices the cost of such travel modifications and repairs shall be assumed entirely by the Customer Upon request of the Customer Taiga Zone will prepare a cost estimate for such travel modifications and repairs Section 8 details the payments required when the Customer is called on to assume the costs of such travel modifications and repairs Payments Required when the Customer Is Liable for a Share of the Costs Related to the Repair of a Manufacturing Defect in a Part 8 In the event as stated in Sections 6 and 7 that the Customer is required to assume labour costs and all or a portion of the material costs related to the repair of a Manufacturing Defect in a Part the Customer shall pay Taiga Zone prior to the start of repairs an amount equivalent to half of the labour costs to be assumed by the Customer plus
16. n et Guide d utilisation et d entretien d Les dommages r sultant d v nements providentiels ou de force majeure tels mais sans en limiter la g n ralit la foudre une inondation la crue des eaux le d bordement de tout cours ou tendue d eau un tremblement de terre les mouvements du sol ou des conditions climatiques exceptionnelles comme des gels profonds et des pluies extr mes e Les dommages r sultant de l entretien inad quat ou de la mauvaise utilisation de la piscine ainsi que les suppressions modifications ou ajouts r alis s par le Client Ta ga Zone insiste fortement sur l importance d observer les directives et conseils d entretien consign s dans le Guide pour l entretien du bois de votre piscine en c dre et incite le Client suivre les cours sur louverture l entretien et la fermeture des piscines offerts par les d taillants En particulier mais sans restreindre la port e de ce qui pr c de on porte l attention du Client les dommages suivants qui r sultent d un entretien fautif dont la responsabilit incombe enti rement au Client tout dommage occasionn par un hivernage d fectueux par une eau de mauvaise qualit ou d acidit lev e par une piscine laiss e vide par la vidange de la piscine et par un mauvais entretien du bois de la piscine Comme indiqu sur le contrat d achat du Client si le Client a omis de faire les choses suivantes contrairement aux recommandations f
17. nd photos of the problem the Retailer will appropriately review the situation and inform the Customer whether the Parts show Manufacturing Defects and if applicable will inform the Customer of repairs required on the Parts to correct said Manufacturing Defects If the Customer is unable to provide a detailed description of the anomaly or particularity with supporting photos the Customer may request the assistance of the Retailer technician In this case travel costs will be billed to the Customer Repairing Manufacturing Defects in Parts During the First Two Years of the Warranty Period 5 If a review of the situation as described in Section 4 concludes that repairs are required to correct Manufacturing Defects in Parts and if such repairs are carried out in the first two years of the warranty period the cost of these repairs to the Parts and only repairs to the Parts shall be assumed by Taiga Zone Repair of Manufacturing Defects in Parts Between the Start of the Third Year and the End of the Last Year of the Warranty Period 6 If a review of the situation as described in Section 4 concludes that repairs to correct the Manufacturing Defects of Parts are required and if such repairs are carried out between the start of the third year and the end of the last year of the warranty period the Customer shall assume all labour costs while the material costs shall be divided between Taiga Zone and the Customer as described in Section 9 of this docu

19. ntie de Taiga Zone concernant les Composantes 2 Aux fins de cette garantie concernant les Composantes dont il est fait tat la section no 1 le d faut de fabrication ci apr s d sign D faut de Fabrication D fauts de Fabrication en est un qui i porte une s rieuse atteinte la qualit la s curit ou l utilisation de la piscine ou ii rend la piscine impropre l usage auquel elle est destin e ou diminue gravement son utilit ou iii affecte une Composante importante qui compromet la solidit de la construction Toutefois les dommages et d gradations dont fait tat la section no 12 ne r sultant pas de D fauts de Fabrication des Composantes sont exclus de la garantie concernant les Composantes et n engagent nullement la responsabilit de Taiga Zone Dur e de la garantie de Ta ga Zone concernant les D fauts de Fabrication des Composantes 3 La garantie de Taiga Zone concernant les D fauts de Fabrication entre en vigueur a la date d achat indiqu e la facture d achat et expire la fin de la quinzi me ann e suivant la date d achat D s l expiration de la garantie Ta ga Zone est d s lors d gag e de toute responsabilit en ce qui concerne tout dommage usure r parations ou remplacement aux Composantes et le Client doit d s lors assumer tous les frais relatifs aux r parations et remplacements des Composantes quelles que soient les causes et circonstances menant de tels r parations o
20. s shifting soil or unusual climatic conditions such as a deep freeze or heavy downpour e Damage to the installation caused by the inadequate care and improper use of the pool as well as by removals modifications or additions carried out by the Customer Taiga Zone strongly emphasizes the importance of complying with the maintenance tips and instructions found in the Maintenance Guide for your Cedar Pool s Wood and encourages the Customer to take the pool opening maintenance and closing classes offered by the pool Retailers In particular but without limiting the scope of the preceding Customer is made aware of types of damage resulting from improper care that are the responsibility of the Customer these include damage caused by improper winterizing poor water quality including acidity outside the acceptable range leaving the pool empty improper drainage and inadequate care of the wood As stated on the Customer s purchase agreement if the Customer has failed to do the following contrary to the recommendations made any damage that may occur to the pool s wood rot mold etc would not be covered by this warranty Stain the wood on the outside only to allow wood to breathe and avoid mold or rot After the pool s installation put a geotextile fabric and stone or river pebbles over the canvas all around the pool on a width of 12 inches and nothing else in this 12 inch perimeter no planting grass mulch top soil etc neit
21. the extension of the warranty period for the Parts The warranty as stated in Section 3 comes into effect on the purchase date indicated in the sales contract and expires at the end of the fifteenth year following the said date of purchase Appearance of Parts Following Repair 11 Taiga Zone will make every effort to preserve the appearance prior to repair of the Parts but is unable to warrant to the Customer that it will be able to do so Warranty Exclusions 12 The following instances of damage deterioration and change in appearance are not caused by Manufacturing Defects in Parts and shall in no way impose any liability on Taiga Zone a Damage to the pool resulting from materials equipment and accessories furnished and installed by the Customer that impede or interfere with the normal operation of the pool b Damage caused by a major accumulation of water in the ground the effect of keeping a pool entirely empty a deep freeze or the effects of the freeze thaw cycle Imp_jan 2011 modifi e le 11 oct 2012 c Damage resulting from an installation performed by the Customer and the Customer s agents that fails to comply with Taiga Zone standards as described in the Construction Specifications brochures and the Use and Maintenance Guide d Damage to the installation resulting from an act of God or force majeure such as but not limited to lightning flooding the overflow of moving or stationary bodies of water earthquake
22. u remplacements Signalement d un possible D faut de Fabrication d une Composante 4 Le Client doit signaler imp rativement et promptement par crit au d taillant qui lui a vendu la piscine ci apr s d sign le D taillant toute anomalie ou particularit d une Composante qui pourrait indiquer un possible D faut de Fabrication et lui fournir une description d taill e avec photographies l appui de l anomalie ou particularit constat e Tel signalement doit parvenir au D taillant au plus tard deux semaines apr s la premi re apparition de l anomalie ou particularit Tout retard dans le signalement aura pour effet d annuler la garantie ou d en r duire l application Sur r ception de la description d taill e et des photos le D taillant fera une analyse appropri e du signalement re u et informera le Client si la Composante en question pr sente ou non un D faut de Fabrication et s il y a lieu l informera aussi de la r paration qui doit tre effectu e pour corriger ledit D faut de Fabrication Dans l ventualit o le Client ne pourrait lui m me fournir une description d taill e de l anomalie ou particularit avec photographies l appui le Client peut demander l intervention du technicien du D taillant et dans ce cas des frais de d placement seront factur s au Client R paration de D faut de Fabrication d une Composante effectu e au cours des deux premi res ann es de la
