The performance check is to confirm that the performance ratio PR of the installed PV is not less than the proposed value during the first two years of operation e n case the result of the performance check fails to achieve the mentioned criteria in the first year the Contractor will be notified to repair any problem or system inconvenience n case the Contractor fails to repair the PV system operation at the end of the second year the maintenance and operational guarantee bond will be liquidated The successfulness of performance check results releasing the maintenance and operational guarantee bond 8 Penalties e Ifthe main Contractor fails to complete the works of any Building within the time for completion EAEE has the right to apply delay penalties as follow 1 of contract price for the first week 2 of contract price for the second week 3 of contract price for the third week 4 of contract price for the fourth week 5 of contract price for each month or any part of it Such that it does not exceed 15 of the final contract price the penalty shall be applied without any need for notice or legal action upon delay takes place e EAEE has the right to cancel all or part of this penalties if the main contractor introduce an acceptable excuse for such delay e The penalty of the un successfulness of the performance check in the second year is liquidating the performance guarantee bond 9 Ann
