10. 2 10 Indemnification The Contractor shall indemnify and hold harmless the City their officials officers agents and employees from and against claims damages losses and expenses including attorney s fees arising out of or resulting from performance of the work provided that such a claim damage loss or expense is attributable to bodily injury sickness disease or death or to injury to or destruction of property of any kind including loss of use resulting therefore but only to the extent caused in whole or in party by any acts or omissions of the contractor any subcontractor anyone directly or indirectly employed by them or anyone for whose acts they may be liable It is understood and agreed that this indemnification obligation is enforceable to the full extent permitted by Ohio Revised Code Section 2305 31 In any and all claims against the City or its officials officers agents or employees or combination thereof by any employee of the contractor any Subcontractor anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable contractor hereby expressly waives the immunity provided to contractor by Article II Section 35 of the Ohio Constitution and Ohio Revised Code Section 4123 74 and 4123 741 so that this indemnification obligation my be enforced by the City against Contractor in those instances The indemnification obligation shall not be limited in any way by the insurance requ
